   <title>National Director of Public Prosecutions v Moodley and Others (263/08) [2008] ZASCA 137 (26 November 2008)</title>

   <description>The SCA today upheld an appeal by the National Director of Public Prosecutions against a judgment of the High Court, Pietermaritzburg, setting aside three counts of racketeering in drugs preferred against the respondents.&lt;br&gt;
&lt;br&gt;
The respondents had sought to have the counts set aside on the ground that they had been charged with racketeering before Mr Bulelani Ngcuka, the National Director of Prosecutions, had given his written authorisation for the prosecution, as required by the Prevention of Organised Crime Act. It was common cause that the respondents had not yet been asked to plead to any of the counts contained in the charge sheet when the written authorisation was given.&lt;br&gt;
&lt;br&gt;
In the High Court Mr Justice Nicholson, with whom Mr Justice Ntshangase concurred, set aside the racketeering counts on a totally different ground and one not raised by the respondents, namely that Mr Ngcuka's written authorisation was invalid for want of particularity regarding such details as to dates and the places at which the offences were committed.&lt;br&gt;
&lt;br&gt;
On appeal, the respondents abandoned the ground relied upon by the High Court and sought the relief they claimed on the ground they had advanced in the High Court and which had not been dealt with in the judgment of the High Court.&lt;br&gt;
&lt;br&gt;
The SCA noted that the abandonment was correct in the circumstances and that the order made by the High Court regarding the invalidity of the authorisation was not to serve as a precedent. With regard to the ground relied upon by the respondents, the SCA held that whatever the position may have been prior to the National  Director's written authorisation, once it was granted the prosecution was lawful. Accordingly the appeal had to succeed.&lt;br&gt;

   <title>Siltek Holdings (Pty) Ltd (in Liquidation) t/a Workgroup v Business Connexion Solutions (Pty) Ltd (081/08) [2008] ZASCA 136 (26 November 2008) </title>

Today, the Supreme Court of Appeal (the SCA) overturned the judgment of the Pretoria High Court in terms whereof a claim by the liquidator of the appellant company was dismissed.&lt;br&gt;
&lt;br&gt;
The appellant owed the respondent a sum of R594 032 in 
September 2001. At the same time the respondent owed the appellant a sum of R436 430. The latter amount was not yet payable when the appellant was liquidated for failing to pay its debts.&lt;br&gt;
&lt;br&gt;
The appellant claimed it but the respondent refused to pay, contending that it had set off its own debt in the amount of R594 032 against the sum claimed by the liquidator. The trial court upheld the defence of set-off.&lt;br&gt;
&lt;br&gt;
On appeal the SCA reversed the trial court’s decision on the basis that the respondent could not invoke set-off because the appellant’s debt became payable after liquidation had occurred. Nor could it invoke set-off before liquidation because one of the reciprocal debts was not yet payable. The SCA held that for set-off to come into operation, both debts have to be payable. But where liquidation intervenes before the second debt has become payable, set-off cannot be invoked. </description>

   <title>Fourway Haulage SA (Pty) Ltd v SA National Roads Agency Ltd (653/07) [2008] ZASCA 134 (26 November 2008) </title>

   <description>On 26 November 2008 the Supreme Court of Appeal dismissed the appeal of Fourway Haulage SA (Pty) Ltd ('Fourway') against the judgment of the Pretoria High Court in favour of the SA National Road Agency Ltd ('the Agency'). Fourway is a long distance haulier. The Agency is the entity authorised by statute to levy and collect toll fees on toll roads.&lt;br&gt;
&lt;br&gt;
The dispute between the parties which gave rise to the appeal originates from an accident which occurred on 26 September 2003 on the N1 between Polokwane and Mokopane in the Limpopo province. The two vehicles involved were an articulated truck and a light delivery van. The articulated truck was driven at the time by an employee of Fourway who was acting in the course and scope of his employment.&lt;br&gt;
&lt;br&gt;
The articulated truck was on its way from an asbestos mine in Zimbabwe to the Durban harbour and carried about 34 tonnes of chrysolite asbestos, destined for export. As a result of the collision, the truck overturned and spilled its cargo onto a portion of the national road and its surroundings. Because of the hazardous nature of the asbestos powder, the spillage required an extensive cleaning-up operation of the polluted area. To facilitate the cleaning-up process, the traffic authorities closed the section of the national road involved and diverted the traffic in both directions onto an alternative road. This lasted for about 24 hours. The section of the national road which was closed forms part of a toll road. The alternative route was not subject to toll. As a result of the closure, two toll plazas could not collect toll fees. Based on these facts, the agency instituted an action against Fourway for the damages it allegedly suffered in the form of loss of toll revenue.&lt;br&gt;
&lt;br&gt;
In the Pretoria High Court Fourway was held liable in principle for the damages.&lt;br&gt;
&lt;br&gt;
On appeal it was not in dispute that the collision had been caused by the negligence of Fourway's driver or that it necessitated the closure of the toll road which in turn caused the Agency to suffer a loss in toll income. In consequence the dispute turned on the enquiry whether as a matter of legal policy, liability should be imposed on Fourway for the Agency's so-called pure economic loss, ie loss not resulting from physical damage to its property.&lt;br&gt;
&lt;br&gt;
Underlying to the dispute was the principle of our law that, unlike damages arising from physical damage to the plaintiff's property or person, so-called pure economic loss does not normally attract liability. The reason for the reluctance to extend liability to the latter kind of loss is essentially to be found in the fear of indeterminate liability. What gives rise to this fear can, in the present context, be illustrated by the example of a businessman who wishes to claim damages suffered because he missed a flight to London with the resulting loss of a lucrative business opportunity, owing to the closure of the road.&lt;br&gt;
&lt;br&gt;
In this case, however, so the Supreme Court of Appeal found, there was no prospect of indeterminate liability. The loss claimed was suffered by a single plaintiff and is finite in its extent.&lt;br&gt;
&lt;br&gt;
Other policy considerations in favour of imposing liability on Fourway, so the SCA held, were that:
a)	The Agency could not readily protect itself against the risk of such loss by concluding a contract with every user of the toll road.
b)	The extension of liability for the Agency's loss would not impose an additional burden on the driver of Fourway – for whose negligence it was held responsible – in that the driver was already under an obligation towards other users of the road to drive with reasonable care.
c)	If toll fees were to be increased in order to accommodate losses of this kind, it would mean that innocent users of the toll road would effectively be held responsible for the negligent conduct of Fourway's employee.&lt;br&gt;
&lt;br&gt;
That, in short, is why the SCA agreed with the High Court's decision to hold Fourway liable for the Agency's loss.</description>

   <title>S v Street (164/08) [2008] ZASCA 133 (26 November 2008) </title>

The appellant in this matter was tried in the Regional Court on a charge of murder, it having been alleged that he had stabbed Patrick Perreira Caetano to death during an incident which occurred in Kyalami on 29 December 2002.&lt;br&gt;
&lt;br&gt;
The appellant was convicted of murder in the regional court and sentenced to 15 years imprisonment. On appeal to the High Court, Johannesburg the conviction and the sentence of 15 years imprisonment were set aside and were replaced by a conviction as an accessory after the fact to the murder and a sentence of five years imprisonment.&lt;br&gt;
&lt;br&gt;
In a further appeal to the Supreme Court of Appeal, the conviction as an accessory after the fact and the sentence of five years imprisonment were set aside and replaced with a conviction of common assault and a fine of R6 000.00 or six months imprisonment, half of which was conditionally suspended for three years.

   <title>Geldenhuys v National Director of Public Prosecutions and Others (CCT 26/08) [2008] ZACC 21 (26 November 2008) </title>

   <description>On 26 November 2008 the Constitutional Court handed down judgment in a case concerning  the confirmation of an order made by the Supreme Court of Appeal (SCA) declaring sections 14(1)(b) and 14(3)(b) of the Sexual Offences Act 23 of 1957 unconstitutional and invalid.  The effect of those provisions was to make the age of consent for same-sex sexual relations 19 years, as opposed to 16 years for heterosexual sexual relations.&lt;br&gt; 
&lt;br&gt;
The Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007 (Criminal Law Amendment Act) which came into effect on 16 December 2007 has repealed these provisions.  This matter is therefore about the protection of persons, like the applicant, who claim to have been unjustly convicted in terms of unconstitutional legislation then in force.&lt;br&gt;
&lt;br&gt;
The applicant, Izak Andreas Geldenhuys, had sexual relations with a boy below the age of 19 years and was convicted on 10 counts of contravening the now repealed provisions of the Sexual Offences Act.&lt;br&gt;
&lt;br&gt;
The SCA found the differentiation between the ages of consent for same-sex and heterosexual persons to be unfair discrimination under the Constitution and accordingly replaced the age of 19 years with 16 years, creating a uniform age of consent.  Consequently the SCA overturned, pending confirmation of the order of constitutional invalidity by this Court, the applicant’s convictions on six of the ten counts where the sexual acts in question had taken place after the boy’s 16th birthday.&lt;br&gt;
&lt;br&gt;
In this Court, the applicant, seeking to uphold the order of invalidity, relied on section 9 of the Constitution which forbids discrimination on the ground of sexual orientation.  The respondents, including the Minister of Justice and Constitutional Development, conceded the unconstitutionality of the section.  The only issue before this Court was therefore what the appropriate remedy should be.&lt;br&gt;
&lt;br&gt;
In this regard, the National Director of Public Prosecutions (the first respondent) and the Director of Public Prosecutions (Transvaal Provincial Division of the High Court) (the second respondent) argued that, rather than lower the age of consent to 16 years, it should be set at 18 years for both heterosexual and same-sex sexual activity, in line with the constitutional, international and domestic law definitions and treatment of children as persons under 18 years.&lt;br&gt; 
&lt;br&gt;
Writing for a unanimous Court, Mokgoro J held that the differentiation did amount to unfair discrimination but declined to set the level of consent at 18 years.  In respect of the latter, such a ruling would leave the age of consent to heterosexual sexual relations at 16 years, and thus maintain an incongruity between the ages of consent to heterosexual and same-sex sexual relations.  Further, Parliament has already spoken through the Criminal Law Amendment Act, which set a uniform age of consent of 16 years, and there was no attack on the constitutional validity of the Criminal Law Amendment Act.&lt;br&gt;

The decision of the Supreme Court of Appeal was accordingly confirmed.</description>

The High Court, Pretoria, held that no agreement of sale was concluded on the date of the auction; all that happened was that the respondent bound itself to keep its offer open for seen days. The SCA agreed with the High Court on this issue. The SCA, however, overruled the High Court's decision that a sale would only come into existence when the sellers' confirmation of the sale was communicated to the respondent. The SCA held that having regard to the terms of the conditions of sale it was clear that the sale was confirmed, ie a sale came into existence, the moment the Sellers signed the conditions of sale.&lt;br&gt;

   <title>Weare and Another v Ndebele NO and Others (CCT15/08) [2008] ZACC 20 (18 November 2008</title>

   <description>Today the Constitutional Court handed down judgment in a case concerning an order made by the Pietermaritzburg High Court declaring section 22(5) of the KwaZulu-Natal Regulation and Betting Ordinance 28 of 1957 (the Ordinance) unconstitutional.&lt;br&gt;
&lt;br&gt;
The case arises out of an agreement between the applicants. Betting World (Pty) Ltd carries on the business of bookmaking in eight of South Africa’s nine provinces. It does not do so in KwaZulu-Natal, because section 22(5) of the Ordinance provides that juristic persons – companies like Betting World – may not hold licences to engage in bookmaking in the province. Only natural persons, such as Mr Weare, are permitted to hold these licences in KwaZulu-Natal. In other provinces, both juristic and natural persons may hold licences. In terms of the agreement, Mr Weare was to sell to Betting World, conditionally, the bookmaking business he operates under his licence.&lt;br&gt;
&lt;br&gt;
The authorities in KwaZulu-Natal took the view that the agreement violated section 22(5), whereupon the applicants challenged the constitutionality of the section. The High Court found that differentiation contained in the section was arbitrary and irrational, and ruled that it breached the constitutional right to equal protection and benefit of the law.  It also held that the section constituted unfair discrimination.&lt;br&gt;
&lt;br&gt;
The applicants applied to this Court for confirmation of the High Court’s order. The first respondent, the Premier of KwaZulu-Natal, appealed against the order.&lt;br&gt;
&lt;br&gt;
The Premier argued that the differentiation between natural and juristic persons in section 22(5) reflects the fact that juristic persons, by virtue of their separate legal personality and the limited liability of those who operate them, are more difficult to regulate. Section 22(5) therefore represents a legitimate way to protect the public by ensuring that only natural persons, who are easier to hold accountable, can hold bookmaking licences.&lt;br&gt;
&lt;br&gt;
The applicants contended that the differentiation was obsolete. They noted that the province had for some years been preparing new legislation to replace the Ordinance. The proposed legislation permits juristic persons to hold bookmaking licences. They argued that the exclusion of juristic persons was out of step with modern business realities. The differentiation in the section was therefore no longer rationally linked to the achievement of a legitimate government purpose.&lt;br&gt;
&lt;br&gt;
In a unanimous judgment written by Van der Westhuizen J, the Court held that section 22(5) did not breach the right to equality before the law protected by the Constitution. The regulation of gambling represented a legitimate government purpose. Different practical considerations might indeed apply to the regulation of juristic persons and natural persons, and so it was not irrational to treat the two differently in the interests of regulation. The fact that reform was being considered, and that an allegedly better policy might exist, did not show that the current law was irrational. Furthermore, the section did not amount to unfair discrimination.&lt;br&gt;
&lt;br&gt;
Another question had to be decided, namely whether the invalidation of a provision of a provincial ordinance by the High Court must be confirmed by this Court. Section 172(2)(a) of the Constitution provides that an order of constitutional validity made in respect of a “provincial Act” must be confirmed by this Court.&lt;br&gt;
&lt;br&gt;
Van der Westhuizen J held that section 172(2)(a) reflected the important status of provincial legislation in our constitutional order. Although this status did not necessarily accrue to all pre-1994 provincial enactments, the Ordinance before the Court had been amended by the KwaZulu-Natal provincial legislature and incorporated by reference into a provincial Act regulating gambling. The provincial legislature in effect decided that the Ordinance should be part of the provincial gambling regime. It therefore should be treated as a provincial Act for the purposes of section 172(2)(a).&lt;br&gt;
&lt;br&gt;
The Court therefore held that the order of constitutional invalidity made by the High Court required confirmation by the Court, but declined to confirm the order and upheld the validity of section 22(5).&lt;br&gt;
&lt;br&gt;
The appeal accordingly succeeded and the application for confirmation was dismissed.

   <description>Today, the Supreme Court of Appeal (the SCA) has delivered a judgment dismissing with costs, an appeal by the City of Cape Town (the City) against a decision of the Cape High Court in terms of which a defence raised by the City was rejected. The facts giving rise to the case were the following.&lt;br&gt;
&lt;br&gt;
Mrs Marina Reader and Mr Ian Peploe of Sea Point, Cape Town objected to the approval of building plans of Mrs Julia Ikin. The plans in question were approved by the City and Mrs Ikin built a double-story house on her property in terms of the approved plans. Her neighbours complained that the building obstructed their view of the sea and diminished the value of their properties. The parties own adjacent properties in Sea Point.&lt;br&gt;
&lt;br&gt;
Both Mrs Reader and Mr Peploe instituted a review application in the Cape High Court, challenging the validity of the permit to build and seeking an order for the demolition of Mrs Ikin’s house. They cited her and the City as respondents. In opposing the application the City contended that the applicants should have exhausted domestic appeals before approaching the court and as a result their application must be dismissed. Veldhuizen J upheld this defence and without consideration of the merits, dismissed the application.&lt;br&gt;
&lt;br&gt;
On appeal to the Full Bench, the above finding was set aside. The Full Bench found that s 62 of the Local Government: Municipal Systems Act 32 of 2000, on which the City had relied, did not afford objectors to building permits a “viable internal appeal” and therefore Mrs Reader and Mr Peploe were not obliged to exhaust internal appeals before launching their application. The Full Bench reversed the order granted by the single judge. On a further appeal to the SCA the provisions of s 62 of the Municipal Systems Act were interpreted and the judgment of the Full Bench was confirmed.
